New measures to protect unpublished works in Argentina

Last Friday, Decree 972/2024 was published in the Official Gazette, introducing updates to the registration and safeguarding of unpublished works in Argentina, aligning regulations with technological advancements.

The aim is to modernize and streamline copyright registration, reducing bureaucracy and enabling remote processing for authors and rights holders of unpublished works in Argentina.

Key highlights of the decree:

  1. Deposit of unpublished works: Authors, co-authors, heirs, or rights holders can deposit unpublished works with the DNDA (National Copyright Authority) either in a sealed envelope or as an encrypted digital file.
  2. Validity and renewal: the deposit remains valid for 36 months and can be renewed for equal periods. If not renewed, the DNDA may destroy the work after 30 days.
  3. Return of works: only the author or their heirs may request the return of a work; if the rights holder is not the author, specific or court-approved authorization is required.
  4. Digital deposit: with the digital option, works can be submitted as encrypted, electronically signed files.
  5. System modernization: the DNDA will integrate new technologies to optimize registration processes.
  6. Repeal of previous regulations: prior decrees are repealed to unify and simplify the regulatory framework.

This decree marks a milestone in the protection of unpublished works in Argentina, bringing registration process into the digital age and offering creators greater security and flexibility.
